Terms of Service

These Terms of Service ("Terms") govern your use of Boojee Companion Care ("Companion Care," "Service," "we," "us"), provided by [Boojee legal entity]. By enrolling in or using the Service, you agree to these Terms and to our Privacy Policy and Informed Consent / Enrollment Agreement, which are incorporated by reference.

1 · What the Service is (scope)

Companion Care is a voice-enabled AI companion for wellness support. It offers daily well-being check-ins, validated wellness screenings (UCLA-3, PHQ-2, PHQ-9, GAD-7), trend tracking, optional caregiver notifications, and surfacing of crisis resources. The Service is offered as-is for general well-being support.

2 · You are talking to an AI (AI disclosure)

The companion is artificial intelligence software — not a human being and not a licensed clinician. Its responses are automatically generated and may be inaccurate, incomplete, or inappropriate. Do not rely on it as you would a qualified professional. You will always be told, in the product, that you are interacting with an AI.

3 · No medical advice; not a medical device; screening not diagnosis

  • The Service does not provide medical, psychological, psychiatric, or other professional advice, diagnosis, or treatment, and does not establish a provider-patient relationship.
  • The screenings are screening tools, not diagnostic instruments. A result is not a diagnosis and requires professional follow-up.
  • The Service is not a medical device and is intended as a general-wellness product.
  • Always seek the advice of a qualified health professional. Never disregard or delay professional advice because of something the Service said.

4 · NOT an emergency service

The Service is not an emergency response service and cannot summon help. It does not dispatch emergency responders, contact 911 on your behalf, or provide crisis counseling by a human.

In a medical or safety emergency, call 911. If you are in crisis or thinking about harming yourself, call or text 988 (Suicide & Crisis Lifeline).

The Service may display these resources, but it is your responsibility to seek emergency help. We do not guarantee that any alert or caregiver notification will be delivered, received, or acted upon.

5 · Caregiver notifications

If you enable caregiver notifications, you authorize us to share alerts and trends (not raw transcripts) with the caregiver you designate. You represent that you have the right to share that caregiver's contact information. Notifications are provided on a best-effort basis and may be delayed or fail. You may disable them at any time.

6 · Eligibility and authorized representatives

You must be 18 or older (or an authorized representative acting for an adult user) to enroll. If you enroll on behalf of another adult, you represent that you are their legally authorized representative (e.g., agent under a health-care power of attorney, or guardian) and are authorized to consent for them. We may request proof of authority.

7 · Acceptable use

You agree not to: misuse the Service; use it for anyone without proper consent/authority; attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service; upload unlawful content; or use the Service as a substitute for professional care or emergency services. We may suspend or terminate accounts that violate these Terms or applicable law.

8 · Your account and data

You are responsible for maintaining the confidentiality of your account. Our collection and use of your data is governed by the Privacy Policy. You may exercise your privacy rights (access, delete, correct, export, withdraw consent) as described there.

9 · Fees

10 · Intellectual property

The Service, including software, content, and trademarks, is owned by [Boojee legal entity] or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal wellness use. Screening instruments are used under their applicable public-domain or licensed terms.

You agree to indemnify and hold harmless [Boojee legal entity] from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

14 · Changes to the Service and Terms

We may modify the Service or these Terms. Material changes will be posted with an updated effective date and, where required, communicated to you. Continued use after changes means you accept the updated Terms.

15 · Termination

You may stop using and delete your account at any time. We may suspend or terminate access for violations of these Terms or as required by law. Sections that by their nature should survive (disclaimers, liability limits, indemnity, dispute terms) survive termination.

16 · Governing law and disputes

These Terms are governed by the laws of [STATE], without regard to conflict-of-laws rules. [Insert dispute-resolution mechanism — e.g., informal resolution first; then courts of [venue], OR an arbitration clause with class-action waiver and consumer carve-outs, if used. 17 · Miscellaneous

If any provision is unenforceable, the rest remains in effect. These Terms, with the Privacy Policy and Informed Consent, are the entire agreement between you and us regarding the Service. Our failure to enforce a provision is not a waiver.
